Just a heads up, it would be trivial for the fbi to set up a dark listener to the fediverse and get a copy of every message in the network. We federate to anyone who wants to listen.

Well yes but actually no? Instances don't just blast out all the content. FBI would have to subscribe to every. Single. Instance (or actor). Might be a bit obvious and easy to circumvent.
