So that clears things up in my head.
People were talking about war crimes, but I was thinking "well, it can't be a war crime if the US isn't at war" so clearly it's just plain old murder.

But worse, I just realised that this shit is the sort of stuff they used to make fucking movies about. A clandestine murder opération on foreign / international soil. Clear and Present fucking Danger, but instead of it being covered up and the soldiers abandoned to die, the morons in charge are tweeting about it live and making emojis about the killing.
Amazing.

Nah that's like saying you can't be an imperialist without being in an empire, war crimes refer to a specific kind of crime and perpetrator. A phrase that gets thrown around a lot is the "laws of war" which usually means the behavior of a military in general.

For example, the military genociding a village of the minority enemy of the week is a war crime even if they're citizens.
