Could be a sensible business decision. Why pay Tolkien estate for the rights when their copyright is about to expire. In the meantime, as the estate is selling those rights to anybody with a pulse, LotR brand is going in the gutter, decreasing chance of this movie being a success.

    Those copyrights last until 2043.

    That’s pretty soon, you can begin work ahead of time and in the meantime people might forget such masterpieces as Hobbit 3, Hunt for Gollum, The Rings of Power (this one I actually like but public sentiment is…) or even video game The Lord of the Rings: Gollum.
