I hope it's not governments that make these decisions

Should be judges, game theory experts, activists, NGO reps, ethics philosophers, etc

    It is governments which sign the Geneva convention, and the "judges, game theory experts, activists, NGO reps, ethics philosophers, etc" they allow/amplify are ultimately further expressions of those governments.

    We come back to "everything is political", which is 100x more true for technocratic entities that claim to just be calling balls and strikes.
